Pats' fan must pay $65K for defaulting on luxury seat deal



Boston (AP)  -- A fan who bought luxury seats for New England Patriots' games at Gillette Stadium has been ordered to pay more than $65,000 after he defaulted on a 10-year contract.

Real estate developer Paul Minihane signed a 10-year agreement with the developer of the stadium to pay $3,750 per seat each year for the 2002 through 2011 seasons.

After he defaulted during the first year, the stadium developer sued him, saying the agreement called for him to pay in full for the remaining years. A Superior Court judge found the provision was an unlawful penalty.

But the Supreme Judicial Court ruled Thursday that the provision is enforceable and ordered Minihane to pay the developer $65,000, plus interest.

Minihane is the former chairman of the Boston Finance Commission.
